1. Acceptance of Terms
These Terms of Service (“Terms”) form a binding contract between you and FurMarket LLC, a Wyoming limited liability company (“FurMarket,” “we,” “us”), governing your access to and use of the website located at fur-market.com and all related services (collectively, the “Platform”). By accessing or using the Platform, you accept these Terms. If you do not accept, you may not use the Platform. We may update these Terms at any time; your continued use after changes are posted constitutes acceptance.
2. Marketplace Facilitator Status
FurMarket is a marketplace facilitator and technology platform, not a seller, importer, distributor, or merchant of any item listed. Sellers are independent third parties. FurMarket:
- Does not own, take possession of, inspect, authenticate, or appraise any item.
- Does not employ, supervise, or control sellers, who act as independent contractors selling their own goods.
- Provides only the technology, payment, escrow, and dispute infrastructure that facilitates transactions between buyers and sellers.
- May, where required by state law, collect and remit sales tax on transactions as a registered marketplace facilitator.
3. Account Registration
To use most Platform features you must register an account. By registering, you represent and agree:
- You are at least 18 years of age and a resident of the United States.
- The information you provide is accurate and current, and you will keep it updated.
- You will keep your password confidential and accept responsibility for all activity under your account.
- You will not register more than one account without our written permission, nor register on behalf of someone other than yourself.
- FurMarket may suspend or terminate any account at any time, with or without cause or notice, including for suspected violation of these Terms.
4. Marketplace Rules
All users agree to:
- Conduct transactions honestly and in good faith.
- Communicate respectfully through the Platform’s messaging system.
- Comply with all applicable local, state, and federal laws.
- Not manipulate listings, search results, pricing, ratings, or feedback through any artificial means.
- Not circumvent the Platform’s payment system, contact buyers/sellers off-platform to complete a transaction, or otherwise avoid platform fees.
- Not use the Platform to scrape data, train AI models, or build a competing product.
5. Listing Policies
Sellers must ensure that every listing:
- Includes clear, accurate descriptions and unedited photographs of the actual item being sold.
- Discloses all material defects, repairs, alterations, restoration, or replacement parts.
- States pricing in US dollars and reflects the true asking price.
- For auctions, clearly states the starting bid and auction end time.
- Identifies whether items are real fur, faux fur, or a blend, and identifies the species where applicable.
- Specifies a realistic shipping timeline (default: 3 business days after payment).
- Complies with all applicable regulations regarding the sale and shipment of fur and animal products.
6. Prohibited Items & Wildlife Regulations
You may not list, sell, or attempt to sell any of the following:
- Items obtained, taken, transported, possessed, or sold in violation of the Lacey Act (16 U.S.C. §§ 3371–3378), including any wildlife taken without proper licensing or in violation of state, federal, tribal, or foreign law.
- Fur, hide, or parts of any species protected by the Endangered Species Act, Marine Mammal Protection Act, or CITES.
- Counterfeit or misrepresented items, including faux labeled as real or vice versa.
- Items the seller does not have the legal right to sell, or stolen property.
- Items that cannot be legally sold or shipped to the buyer’s jurisdiction (including state-level fur or trapping bans).
- Hazardous materials, items posing a public health risk, or items requiring special licensing the seller does not possess.
- Non-fur items, except direct fur-related accessories (e.g., garment bags, pelt brushes, storage products).
FurMarket may remove any listing without notice. Sellers are solely responsible for verifying that their items comply with all applicable wildlife laws, and bear all consequences (civil and criminal) of non-compliance.
7. Seller Representations and Warranties
By listing any item, the seller represents and warrants that:
- The seller is the lawful owner of the item and has the unrestricted right to sell, transfer, and ship it.
- The item is accurately and completely described in the listing, including all material defects, repairs, restoration, and provenance information known to the seller.
- The item complies with all applicable wildlife, import/export, customs, and consumer protection laws, including the Lacey Act and CITES.
- The sale and shipment of the item to the buyer’s state and country are legal under the laws of both jurisdictions.
- The seller has obtained all required licenses, permits, tags, or certifications associated with the item.
- The item does not infringe any intellectual property right, contractual obligation, or third-party right.
- The seller will ship using a trackable carrier within the timeframe stated in the listing.
- All photographs in the listing are of the actual item being sold and have not been deceptively edited.
8. Buyer Responsibilities
- Review listing descriptions and photos carefully before purchasing.
- Verify that any item is legal to receive and possess in your jurisdiction before purchasing.
- Complete payment promptly after committing to a purchase or winning an auction.
- Inspect items within the 3-day inspection window upon delivery.
- Use the Platform’s dispute process before initiating chargebacks with your card issuer.
- Communicate with sellers through the Platform’s messaging system.
9. Escrow and Payment
FurMarket uses an escrow-based payment system to protect both buyers and sellers:
- Buyer Payment: Funds are held in escrow by our payment processor (Stripe) until the transaction is finalized.
- Seller Commission: 5% of the item sale price is deducted from each completed sale.
- Buyer Service Fee: 3% of the item price is charged at checkout, covering payment processing, buyer protection, and platform services.
- Payouts:Released to the seller after the buyer’s 3-day inspection window closes without dispute, or upon explicit buyer confirmation.
- Refunds: Returned to the buyer in the event of a successful dispute per the Buyer Protection Policy.
- Stripe Connect:All sellers must complete Stripe Connect onboarding (which performs identity and bank verification under Stripe’s Know Your Customer rules) before receiving payouts.
10. No Authentication; No Warranty of Items
FurMarket does not authenticate, inspect, appraise, or warrant any item listed on the Platform. All items are sold by independent third-party sellers. FurMarket makes no representation or warranty, express or implied, regarding any item’s quality, authenticity, condition, species, provenance, value, fitness for a particular purpose, or merchantability.
Any opinions, descriptions, photographs, certifications, or representations regarding items are made by the seller, not FurMarket. Buyers purchase at their own risk and are responsible for their own due diligence prior to purchase.
11. Indemnification
You agree to indemnify, defend, and hold harmlessFurMarket LLC and its officers, members, employees, agents, contractors, successors, and assigns from any and all claims, demands, losses, damages, fines, penalties, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or activity on the Platform; (b) any item you list, sell, or purchase; (c) your breach of these Terms or any representation, warranty, or covenant herein; (d) your violation of any applicable law, including wildlife regulations and tax law; (e) any third-party claim arising from your content, listings, or conduct. FurMarket reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to your indemnification, in which case you will cooperate with FurMarket’s defense.
12. Disclaimers and Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
- FurMarket does not warrant that the Platform will be uninterrupted, secure, error-free, or that defects will be corrected.
- FurMarket shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, or business interruption, even if advised of the possibility.
- FurMarket’s total aggregate liability to you for all claims arising under these Terms or your use of the Platform shall not exceed the greater of (i) the total fees you paid to FurMarket in the twelve (12) months preceding the claim, or (ii) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you to the extent prohibited by applicable law.
13. Force Majeure
FurMarket shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, pandemics, government action, labor disputes, internet or telecommunications failure, or third-party service outages (including Stripe, Supabase, Vercel, or any other vendor).
14. Intellectual Property; License of Content
The FurMarket name, logo, fox icon, Platform design, code, and all related content are the property of FurMarket LLC and protected under applicable copyright, trademark, and other laws.
By posting content (including listing photos, descriptions, profile information, or messages), you grant FurMarket a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, display, distribute, and create derivative works of that content in connection with operating, promoting, or improving the Platform. You retain ownership of your content. If you believe content on the Platform infringes your copyright, send a notice to legal@fur-market.com with the information required by 17 U.S.C. § 512(c)(3).
15. Dispute Resolution; Arbitration; Class Waiver
Disputes between users (buyer/seller) are handled under the Buyer Protection Policy. Disputes between you and FurMarket are subject to the following:
- Informal resolution first: Before filing arbitration, you must email legal@fur-market.com with a written description of your claim and allow 30 days for resolution.
- Binding arbitration: If unresolved, the dispute will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator on a documents-only basis where possible, or otherwise virtually.
- Venue: If an in-person hearing is required, it shall take place in Eau Claire County, Wisconsin, or another mutually agreed location.
- Class action waiver: You waive the right to participate in any class, collective, or representative action against FurMarket. All claims must be brought individually.
- Carve-outs:Either party may bring an individual claim in small-claims court for amounts within that court’s jurisdiction, and either party may seek injunctive relief in court to protect intellectual property.
16. Governing Law
These Terms are governed by the laws of the State of Wyoming (where FurMarket LLC is organized), without regard to conflict-of-laws principles. To the extent any matter falls outside the scope of arbitration, exclusive jurisdiction and venue lies in the state and federal courts located in Eau Claire County, Wisconsin (where FurMarket operates), and you consent to personal jurisdiction there.
17. Termination
FurMarket may suspend or terminate your access at any time, with or without cause or notice, including for:
- Violation of these Terms or any FurMarket policy.
- Suspected fraudulent, abusive, or illegal activity.
- Repeated disputes, chargebacks, or negative seller performance.
- Request by law enforcement or government agency.
You may close your account at any time by contacting support. Upon termination, you remain responsible for any outstanding obligations, and Sections 7, 10, 11, 12, 14, 15, 16, and 18 survive termination.
18. Miscellaneous
- Entire agreement: These Terms, together with the Privacy Policy and Buyer Protection Policy, are the entire agreement between you and FurMarket regarding the Platform.
- Severability: If any provision is held unenforceable, the remainder remains in full force and effect.
- No waiver: A failure to enforce any provision is not a waiver of future enforcement.
- Assignment: You may not assign these Terms; FurMarket may assign them in connection with a merger, acquisition, or sale of assets.
- No agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and FurMarket.
