1. Acceptance of Terms

By accessing or using the FurMarket website and services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Platform. FurMarket reserves the right to update these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and update your account information to keep it accurate.
  • Keep your password confidential and not share it with third parties.
  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Accept responsibility for all activity that occurs under your account.

FurMarket reserves the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Marketplace Rules

FurMarket is a platform that connects buyers and sellers of fur products. As a marketplace, we facilitate transactions but are not a party to the sale itself. All users must:

  • Conduct transactions in good faith and with honesty.
  • Communicate respectfully with other users.
  • Comply with all applicable local, state, and federal laws.
  • Not manipulate pricing, feedback, or search results.
  • Not circumvent the Platform’s payment system to avoid fees.

4. Listing Policies

Sellers must ensure that all listings are accurate and comply with the following:

  • Listings must include clear, accurate descriptions and photos of the actual item being sold.
  • All material defects, damage, or alterations must be disclosed.
  • Pricing must be stated in US dollars and reflect the true asking price.
  • Listings for auction must clearly state the starting bid and auction duration.
  • Sellers must ship items within the timeframe stated in their listing (default: 3 business days after payment).
  • Sellers must comply with all applicable regulations regarding the sale and shipment of fur products.

5. Prohibited Items

The following items are strictly prohibited from being listed on FurMarket:

  • Fur products derived from endangered or protected species in violation of CITES or the Endangered Species Act.
  • Counterfeit or misrepresented items (e.g., faux fur labeled as real fur, or vice versa).
  • Stolen property or items the seller does not have the legal right to sell.
  • Items that violate any federal, state, or local law, including import/export restrictions.
  • Items containing hazardous materials or that pose a health risk.
  • Any non-fur items unless they are fur-related accessories (e.g., garment bags, brushes).

FurMarket reserves the right to remove any listing that violates these policies without notice.

6. Buyer Responsibilities

  • Review listing descriptions and photos carefully before purchasing.
  • Complete payment promptly after committing to a purchase or winning an auction.
  • Inspect items within the 3-day inspection window upon delivery.
  • Communicate with sellers through the Platform’s messaging system for any issues.
  • File disputes within the designated timeframe if an item is not as described.
  • Not initiate chargebacks outside the Platform’s dispute process without first attempting resolution through FurMarket.

7. Seller Responsibilities

  • Complete the seller verification process before listing items for sale.
  • Provide accurate descriptions and authentic photographs of items.
  • Ship items within the stated timeframe using trackable shipping methods.
  • Package items securely to prevent damage during transit.
  • Respond to buyer inquiries and disputes in a timely manner.
  • Maintain compliance with all applicable tax obligations, including collecting and remitting sales tax where required.
  • Not engage in shill bidding or any form of auction manipulation.

8. Escrow and Payment Terms

FurMarket uses an escrow-based payment system to protect both buyers and sellers:

  • Buyer Payment: When a buyer completes a purchase, funds are held in escrow by our payment processor (Stripe) until the transaction is finalized.
  • Seller Commission: A 5% commission is deducted from the sale price upon successful completion of the transaction.
  • Buyer Service Fee: A 3% service fee is charged to the buyer at checkout, covering payment processing, buyer protection, and platform services.
  • Payment Processing:All payments are processed through Stripe. Standard Stripe processing fees apply and are included within the Platform’s fee structure.
  • Payout Schedule:Seller funds are released after the buyer’s 3-day inspection window closes without a dispute, or when the buyer confirms receipt and satisfaction.
  • Refunds: In the event of a successful dispute, funds are returned to the buyer per our Buyer Protection Policy.

9. Intellectual Property

The FurMarket name, logo, website design, and all related content are the intellectual property of FurMarket and are protected by applicable copyright, trademark, and other intellectual property laws.

By posting content on the Platform (including listing photos and descriptions), you grant FurMarket a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and promoting the Platform. You retain ownership of your content and may remove it at any time by deleting your listings.

10. Limitation of Liability

To the maximum extent permitted by law:

  • FurMarket is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
  • FurMarket does not guarantee the quality, authenticity, or legality of items listed by sellers.
  • FurMarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • FurMarket’s total liability to you for any claim arising from these Terms shall not exceed the total fees paid by you to FurMarket in the 12 months preceding the claim.

11. Dispute Resolution

In the event of a dispute between users, FurMarket provides a dispute resolution process as outlined in our Buyer Protection Policy. For disputes between you and FurMarket:

  • You agree to first attempt to resolve any dispute informally by contacting FurMarket support.
  • If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Arbitration shall take place in Madison, Wisconsin, or at a mutually agreed location.
  • You waive the right to participate in class action lawsuits or class-wide arbitration.

12. Termination

FurMarket may suspend or terminate your access to the Platform at any time, with or without cause, including but not limited to:

  • Violation of these Terms or any FurMarket policy.
  • Fraudulent, abusive, or illegal activity.
  • Repeated disputes or negative feedback from other users.
  • Request by law enforcement or government agencies.

You may terminate your account at any time by contacting FurMarket support. Upon termination, you remain responsible for any outstanding transactions and obligations.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Dane County, Wisconsin, and you consent to the personal jurisdiction of such courts.
